Terms of Use

These Terms of Use ("Terms") govern your access to and use of Kinset, a strength-training application operated by Charter Oak Strategic Partners, LLC ("Kinset," "we," "us," or "our"). By creating an account or using Kinset, you agree to these Terms.
If you are between 13 and 17 years old, you may only use Kinset if a parent or legal guardian has authorized your participation through our guardian authorization process.
Kinset is not available to persons under 13 years of age.
1. Eligibility
To create a Kinset account as a household owner or adult member, you must:
- Be at least 18 years old.
- Reside in the United States.
- Complete our eligibility verification process before creating an account.
Teen members (ages 13 to 17) may join only through an invitation from an existing household owner who is their parent or legal guardian. The guardian must complete the Guardian Authorization process before the teen can accept the invitation.
2. Accounts and Households
Kinset is organized around households. When you sign up, you create a household and become its owner. As the owner, you may invite other adults and teens to join your household.
Owner responsibilities:
- You are responsible for maintaining the security of your account.
- If you invite a teen, you represent that you are their parent or legal guardian and that you have authority to authorize their participation.
- You may remove members from your household at any time.
- You may withdraw guardian authorization for a teen at any time, which immediately ends their access.
All members:
- You are responsible for providing accurate information during account creation.
- You may not share your account credentials with others.
- You may not create more than one account.
3. The Service
Kinset provides strength-training workout generation, exercise logging, progress tracking, and household coordination features. The service includes:
- Workout generation based on your equipment, goals, and training history.
- Exercise logging with persistent offline queue for gym-floor reliability.
- Progress tracking including estimated one-rep max, personal records, and recovery modeling.
- Joint sessions where household members train together with individualized programming.
- Teen mode with age-appropriate training parameters based on published guidelines from the National Strength and Conditioning Association (NSCA, 2009) and the American Academy of Pediatrics (AAP, 2020).
4. Health and Fitness Disclaimer
Kinset is a fitness tracking and workout generation tool. Kinset is not a medical device and does not provide medical advice. The exercise prescriptions, recovery estimates, and training recommendations generated by Kinset are algorithmic suggestions based on your inputs and training history.
- Consult a physician before beginning any exercise program, especially if you have medical conditions, injuries, or concerns.
- Kinset's teen training parameters are informed by published guidelines but do not replace professional assessment of an individual teen's readiness or competency.
- You assume all risk associated with your use of the exercises and training programs suggested by Kinset.
- Stop exercising and seek medical attention if you experience pain, dizziness, or other concerning symptoms.
5. Acceptable Use
You agree not to:
- Use Kinset for any unlawful purpose.
- Attempt to access another member's private data, including body weight, recovery status, solo workout details, or date of birth.
- Interfere with or disrupt the service or its infrastructure.
- Reverse-engineer, decompile, or otherwise attempt to extract the source code of the service.
- Use automated means to access the service except through our published interfaces.
- Misrepresent your age, identity, or relationship to a minor during account creation or guardian authorization.
6. Data and Privacy
Your use of Kinset is also governed by our Privacy Policy, Consumer Health Data Privacy Notice, and, if applicable, our Teen Privacy Notice. These documents describe what data we collect, how we use it, and your rights.
Key privacy commitments:
- No ads. No third-party analytics trackers on surfaces used by minors. No selling of data.
- Private data (date of birth, body weight, recovery, pain/injury, solo workouts) is private by default and not visible to other household members, including the owner.
- Household owners administer membership but do not automatically receive other members' health data.
7. Intellectual Property
All content, features, and functionality of Kinset (including but not limited to the workout engine, user interface, and documentation) are owned by Charter Oak Strategic Partners, LLC and are protected by applicable intellectual property laws.
The exercise dataset used by Kinset is derived from publicly available sources and is used under their respective licenses. Exercise instructions are original Kinset content.
8. Account Deletion and Data Retention
- Any member may delete their own account through Settings.
- Household owners must remove all other members before deleting their own account. Removing the last member and deleting the owner account effectively deletes the household.
- Guardian withdrawal for a teen immediately ends their access and begins data deletion.
- Upon deletion, your data is removed from active systems within 30 days and from backups within 90 days.
- Legal acceptance records are retained after account deletion as required for compliance.

9. Service Availability
Kinset is currently available in the United States only. We provide the service on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation.
We may modify, suspend, or discontinue the service at any time. We will make reasonable efforts to notify you of significant changes.
10. Limitation of Liability
To the maximum extent permitted by law, Charter Oak Strategic Partners, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
Our total liability for any claim arising from these Terms or the service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
11. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the effective date and version number. If we make material changes, we will notify you through the service and may require you to review and accept the updated Terms before continuing to use Kinset.
12. Governing Law
These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles.
